Terms and Conditions for Online Auctions

Please read the following Terms and Conditions before registering to bid. Click on the link at the bottom of the page to continue the registration process.

You MUST be at least 18 years of age to register and/or bid.

All registration information must be valid. If bidder information changes at any time and/or any reason, bidder must notify bid2buy.us of any such changes before bidding again after change.

As per U.S. Code Title 18 – Crimes & Criminal Procedure Part 1 – Crimes – Chapter 47 – Fraud and False Statements 1030: It is a crime to register online under a false name to gain access in a way that its owner didn't authorize. It constitutes "hacking" and according the law, it is punishable with 5 – 20 years in prison. Any attempts to defraud bid2buy.us, its consignors, or bidders will result in the pursuit of criminal and civil actions to the fullest extent allowed by the law.

As a bidder, you are entering into a contractual agreement between you, the buyer, the consigner and bid2buy.us. It is mutually understood that once you place a bid and win an item, you are obligated to complete the purchase as agreed upon in said terms and conditions described herein. Bidders who fail to follow through with the purchase will be suspended or blocked from bidding in future auctions. bid2buy.us reserves the right to terminate bidding privileges at any time and/or any reason. bid2buy.us reserves the right to reject any and all bids if they so choose for any reason.

As Is – Where Is & Assessing Condition
Everything is sold As Is – Where Is with no warranties expressed or implied. No adjustments of any kind will be made with regard to an item once the item has been removed from selling premises or after the removal date as posted by bid2buy.us, whether or not the property has been removed. Buyers are encouraged to physically inspect any and all items of interest. Inspection can be done during bid2buy.us Showroom hours as posted in the auction listing. Bid2buy.us employs a qualified staff of professionals with a wide variety of knowledge in re-sale items. Although we do our best to ensure all items are properly represented, most descriptions are provided by the sellers and bidders should rely solely on personal inspection and not information listed on the site or otherwise provided by auctioneer or sellers. As stated above; feel free to call the office for further detail or information on items you cannot see in person. Failure to inspect or otherwise be informed of all details no matter how minute, does not absolve the bidder of responsibility. Lack thereof, as stated above, will not be considered for any type of adjustment or refund.

Buyers' Premium
A buyers' premium of 10% will be applied to all winning bids and automatically added to all invoices upon auctions' end. Please see auction information for specific terms of said auction.

Sales Tax
All sales are subject to Michigan 6% sales tax. We require that you provide the necessary documentation for tax exempt purchases at the time of sale.

Payment
Winning bidders will be emailed an invoice after the closing of an auction. If you don't see an invoice, please check your spam and/or junk mail folders. Purchases must be paid in full and picked up within 3 days following the close of any and all auctions. No partial payments will be accepted. All items must be picked up, and/or arrangements to ship at winning bidders expense, during the posted Showroom hours. We understand that unexpected issues can arise which may make it difficult to comply with said timeframe. Because of our commitment to service, we want to help, all we ask is that you contact the Showroom manager to make other arrangements, if one can be made before the scheduled payment/pickup time has expired. The methods of payment accepted by bid2buy.us, unless otherwise stated, include:

  • Cash
  • Credit/Debit Cards
  • Personal Checks
  • Cashier Checks
  • Money Orders
Personal checks require a valid driver's license or state issued photo id and must be drawn on a local bank or financial institution. Any exceptions to the personal check acceptance policy must be approved directly through the Showroom manager. Out of town or out of state personal check purchases will be held until the check clears before items will be released to the customer or shipped to any address.

Removal of Merchandise and Failure to Remove
The buyer is solely responsible for making arrangements to remove all winning bid items for each separate auction within the 3 day guideline even if the item/merchandise is paid for in part or in full. bid2buy.us will consider these as abandoned items and the buyer may be responsible for the removal or disposal of such items. If the buyer fails to pick up items within said guidelines, bid2buy.us reserves the right to suspend and block bidding on future auctions. bid2buy.us also reserves the right to relist or resell any merchandise not removed by the buyer. Buyers must arrange for any additional help in getting large items out of the Showroom. bid2buy.us does not provide for movers, runners, etc. Nor does bid2buy.us provide any type of moving equipment and/or boxes, packing materials, bags, etc. Please come prepared with any help, equipment and/or materials needed. bid2buy.us, consignors and agents shall not be responsible for any damage to items, vehicles, trailers, or personal injuries incurred on bid2buy.us premises or during removal or transport. Changes to the auction end dates/times is subject to change at thebid2buy.us's discretion.

Posted Closing Times
Posted closing times and displays of bid2buy.us's current time are approximate. bid2buy.us reserves the right to close early or extend any auction at any time at its discretion. All times are inEastern Standard Time.

Bid2buy.us's Right to Terminate Purchase
If for any reason bid2buy.us is unable to complete the sale of any purchase to buyer or provide such purchase free and clear of liens, even if the buyer was given notice that he is the high bidder and purchaser, buyer agrees that bid2buy.us may terminate the purchase, in which case bid2buy.us only liability shall be the return of any monies actually paid by the bidder.

Consent to Suit in Michigan
In the event of legal proceedings arising from this contract or from the auction in connection there with, buyer consents to being subject to the personal jurisdiction of the courts of the state of Michigan. Buyer also agrees the venue of said proceedings shall be in Bay County, Michigan and the laws of the State of Michigan shall govern this Agreement and the parties' transaction hereunder. The Buyer expressly agrees to indemnify and save bid2buy.com and their assigns harmless from and against all claims, losses, damage or liability, (including but not limited to, attorney's fees), directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of bid2buy.us or anyone acting in his/her behalf in connection with or arising out of auction, except that the Buyer shall not be responsible to bid2buy.us for damages caused by or resulting from bid2buy.us's sole negligence. Do NOT bid unless you agree to the above terms. By bidding, you are acknowledging agreement with the above terms.

Disclaimer of Warranty and Release
You expressly agree that use of this website is at your sole risk. Neither bid2buy.us, its affiliates, nor any of their officers, directors, employees, agents, third party content providers, or licensors (collectively, "Providers"), or the like, warrant this website will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of this website, or as to the accuracy, completeness, reliability, security, or currency of the website.

The website may contain errors, omissions, inaccuracies, or outdated information. Further, Provider does not warrant reliability of any statement or other information displayed or distributed through the website. Provider reserves the right, in its sole discretion, to correct any errors or omissions in any portion of the website. Provider may make any other changes to this website at any time without notice.

Provider makes reasonable commercial efforts to make the website available at all times. However, Provider is not responsible for any service interruptions, including, but not limited to interruptions that may affect aspects of the sale of auction items.

PROVIDER MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE WEBSITE, THE CONTENT, INFORMATION, OR THE MATERIALS ON THIS WEBSITE. LIMITATION OF LIABILITIES
YOU AGREE THAT PROVIDER AND ITS PROVIDERS SHALL NOT BE LIABLE FOR ANY DAMAGE, LOSS, OR EXPENSE OF ANY KIND ARISING OUT OF OR RESULTING FROM YOUR POSSESSION OR USE OF THE MATERIALS, CONTENT, OR INFORMATION ON THIS WEBSITE OR FROM YOUR PURCHASE OR SALE OF GOODS THROUGH THIS WEBSITE REGARDLESS OF WHETHER SUCH LIABILITY IS BASED IN TORT, CONTRACT, OR OTHERWISE.
